A BPO for Arbitration in India
Arbitration.in is a "Facilitation Center" and an unique portal, the first
of its kind in India.
The objective of this portal
is to enable any existing arbitration councils in India or elsewhere to utilize
online facilities for
a) Back office Management
b) Online Dispute Resolution by Arbitration or Mediation
The services of this center would be available to member
organizations which can be any kind of arbitration council or an individual
arbitrator.
a) Back Office Management
As a Back Office Management service, the center would
assist its members in
1.Making the details of their available arbitration services known to
Netizens,
2. Providing services for registration of requests for
arbitration
3. Providing services for the issue of notices during their
arbitration process
4. Providing services for selection of arbitrators for a
given arbitration.
5. Providing services for arbitration venue management on
request.
The procedure for arbitration, the fees and the choice of
arbitration venue and time is left to the member organization and is to be provided
to the center in electronic form to be displayed.
One or more web pages will be provided for the members to
display their services, profiles, rules, fee structure etc.
The center will forward enquiries received for the member
through e-mail.
The records will be prepared as per the requirement of the
member organization and sent to them for records.
When used for Back Office Management services only, it is envisaged that the arbitration proceedings will be
recorded by the member himself and the services of the center ceases once the
arbitration venue and time is chosen and communicated to the parties.
The arbitration facilitation service may be used along with
the services of CEAC services (www.ceac.in), if
a third party certification of the proceedings is required.

b) Online Dispute Resolution
The online dispute resolution mechanism shall be the unique
feature of this center.
There are two modes in which the online arbitration
support service would be provided.
i) Standard Mode
The "Standard Mode" is similar to the system followed
by many other arbitration centers in the world including the WIPO domain name
arbitration.
Under this mode, the communication with all the parties will
be e-mail based. The center would receive requests from arbitration centers
through e-mails and serve necessary notices both by e-mails and courier.
Response would also be sought both through e-mail and signed paper form. The
finer points of the arbitration including the need for a physical meeting or
otherwise would be determined by the individual arbitrators and the contesting
parties. Where the parties use digital signatures valid in India for their
e-mail communications, no physical communication would be required. Where the
disputing parties so desire they can use back up communication through exchange
of printed copies of the communication.
ii) CEAC Mode
Under this service, the Center will provide an online
arbitration room which will meet the legal requirements as prevalent in India to
enable the proceedings to be legally valid. The discussions held in the
room will be certified by Cyber Evidence Archival Center (http://www.ceac.in) as per the requirements of
law in India for admissible evidences of Cyber transactions.
This service is unique and not available in any
arbitration center so far anywhere in the world.
